The purpose of this policy is to explain how we collect, use and disclose your personal information for the purpose of administering the Firm and our client’s matters and to ensure proper functioning and service delivery to our valued clients.  Personal information for the purpose of this policy includes names, birth dates, identity documents, addresses, email addresses and contact numbers, and such documents and information provided to the Firm by our clients and service providers.  We may gather additional information needed to meet other general, legal and case specific needs we are involved in from time to time.  The information that you provide will be subject to the guidelines set out in this policy below.

The information we collect

We collect and process your personal information mainly to contact you, to deliver services to you and report to you on matters assigned to us and notices for general information purposes.

Only necessary personal information is stored; therefore, we will not collect and store information that is not required for the above purposes. We collect your personal information and the information of your child (if provided to us) directly from you. “We” is a reference to all our functionaries, staff and service providers to the Firm.

How we use information

We will use personal information only for the purposes for which it was collected and agreed with you. By contacting us or using our Website or email addresses you agree to the collection, use and disclosure of your personal information, as outlined in this Policy.

Disclosure of information

We may disclose your information internally or to our staff, volunteers and service providers who are involved in the delivery of services to you or the Firm.  We have agreements with our service providers to ensure that they comply with the Protection of Personal Information Act of 2013.

Consent

By providing us with your or your family’s personal information you give consent to us to:

  1. store your personal information and the personal information of your child or children;
  2. contact you (by email, SMS, WhatsApp or otherwise);
  3. disclose your personal information to parties relevant to your matter, such as amongst others, Government departments (CIPC or The Master of the High Court etc.), Banks and such persons or institutions that serve the Mandate given to us; and
  4. use your personal information as set out herein.

Clients are subject to the Terms of our Engagement Letter which addresses personal information in greater depth.

 

Access to information, record retention, updates and deletion

We will not retain the personal information collected from you for a period longer than necessary.  We may from time to time request updates from you of your personal information to ensure that it is correct. We will notify you when we need your personal information or your family’s information to be updated.

You have the right to request a copy of the personal information we hold about you. You also have the right to ask us to update or correct your personal information at info@gkcattorneys.co.za.

You may also at any time withdraw your consent to use and store your or your family’s personal information, and request deletion of the information, subject to legislation. We will request confirmation of your identity before attending to this request.

Information security safeguards

We have security policies and procedures in place to protect the personal information that we store and to stop unauthorised access thereto and use thereof.

Should we become aware of a breach of our security safeguards that affect your personal information we will notify you thereof as soon as reasonably practical.

This policy will be reviewed annually and updated when necessary and dated consecutively and posted on our Website.
